MHMDA Consumer Health Data Policy

This MHMDA Consumer Health Data Policy is a standalone policy for Paws & Property LLC. It is linked prominently and separately from the Paws & Property homepage and is not combined with unrelated privacy information.

1. Purpose and Scope

Paws & Property LLC ("Paws & Property," "we," "us," or "our") provides pet-sitting, house-sitting, home-watch, transportation, routine property care, delivery oversight, and project coordination services. We are not a human healthcare provider, and we do not intentionally request information about your physical or mental health.

This Policy applies only to "consumer health data" under the Washington My Health My Data Act. For purposes of this Policy, consumer health data means personal information that is linked or reasonably linkable to you and that identifies your past, present, or future physical or mental health status.

Pet health information is not human consumer health data. Information about your pet's medication, allergies, veterinary history, behavior, illness, injury, or care needs is collected to provide safe pet care and is handled under our general Privacy Policy, not this MHMDA Consumer Health Data Policy.

2. Categories of Consumer Health Data We May Collect

We do not seek or request human health information as part of our ordinary services. However, we may receive limited consumer health data if you voluntarily disclose it to us.

Examples may include that you are hospitalized; that you are injured; that you are recovering from surgery; that you are disabled or temporarily unable to travel; that you are experiencing a medical emergency; that you are physically or medically unable to return home as scheduled; or similar information you provide to explain service timing, emergency circumstances, or your availability.

We do not intentionally collect detailed medical records, diagnoses, treatment records, insurance records, prescription records, lab results, medical portal information, or similar detailed human health information.

3. Sources of Consumer Health Data

The usual source of consumer health data is you, the client.

In limited situations, consumer health data may also come from your designated emergency contact; a family member, roommate, or authorized representative who contacts us on your behalf; a veterinarian, emergency responder, law enforcement officer, property manager, or other person involved in an emergency; or written communications you send to us by text, email, booking request, service instruction, voicemail, or other communication method.

4. We Do Not Seek This Information

You are not required to provide human health information to use our services unless limited information is directly necessary for a service request, scheduling change, or emergency situation.

If you need to explain that you cannot return home, cannot pick up your pet, need extended services, or need emergency help, please provide only the minimum information needed for us to understand the request and respond appropriately.

5. How We Use Consumer Health Data

We use consumer health data only for the limited purpose for which it was provided or as otherwise permitted by law.

We may use consumer health data to provide services you requested; adjust scheduling or extend care based on your situation; communicate with you or your emergency contact; protect your pets, property, our personnel, or third parties; respond to emergencies; maintain records reasonably necessary for safety, insurance, legal, payment, or dispute-resolution purposes; and comply with applicable law.

We do not use consumer health data for advertising, marketing, sale, health profiling, targeted offers, or unrelated business purposes. We do not infer health conditions beyond what you actually tell us or what is reasonably necessary to respond to the specific situation.

7. How We Share Consumer Health Data

We do not sell consumer health data.

We share consumer health data only when necessary to provide the service you requested, when you have given any required consent, when necessary in a good faith emergency, or when required or permitted by law.

Categories of consumer health data that may be shared are limited to the information reasonably necessary for the specific purpose, such as the fact that you are hospitalized, injured, delayed by a medical emergency, or medically unable to return home as scheduled.

We may share consumer health data with the following categories of recipients, when reasonably necessary:

Your designated emergency contact; a person you authorize to act on your behalf; veterinarians or emergency animal care providers, if the information is directly relevant to pet care, pet safety, or emergency decision-making; emergency responders, law enforcement, animal control, property managers, landlords, homeowners' associations, locksmiths, utility providers, repair providers, or similar parties when needed to protect pets, people, or property; vendors or service providers who help us operate our business, such as email, cloud storage, phone/text, invoicing, website, analytics, form, or recordkeeping providers; legal, insurance, or professional advisors where necessary to comply with law, respond to claims, document incidents, obtain advice, or protect rights and safety.

We currently have no affiliates with whom we share consumer health data. If that changes, we will update this Policy as required before sharing consumer health data with any affiliate.

We do not share consumer health data with third parties for their own independent marketing, advertising, profiling, or unrelated commercial purposes.

8. Good Faith Emergency Disclosures

In a genuine emergency affecting your safety, your pet's safety, property safety, our personnel, or third parties, we may act on and share limited consumer health data based on our good faith understanding of the situation at the time.

Good faith means our honest, reasonable belief, based on the information available at the time, that disclosure or action was necessary to protect a person, pet, property, or third party.

This emergency standard applies only to genuine emergencies, not routine scheduling matters or marketing.

9. Your Consumer Health Data Rights

If this Policy applies to your consumer health data, you may have the right to confirm whether we are collecting, sharing, or selling consumer health data concerning you; access your consumer health data; receive information about third parties or affiliates with whom we have shared or sold your consumer health data, including a way to contact those third parties where required; withdraw consent for our collection or sharing of your consumer health data; request deletion of consumer health data concerning you; and appeal a denial of your request.

We do not require you to create a new account to exercise these rights. We may require reasonable identity verification before fulfilling a request.

We will not unlawfully discriminate against you for exercising rights under this Policy.

10. How to Submit a Request

Please include your name, contact information, the nature of your request, and enough information for us to reasonably verify your identity and locate the relevant information.

If we cannot verify your identity using commercially reasonable efforts, we may request additional information reasonably necessary to authenticate your request.

11. Response Time, Appeals, and Complaints

We will respond to consumer health data requests without undue delay and within 45 days of receiving the request. If reasonably necessary based on the complexity or number of requests, we may extend the response period once by an additional 45 days. If we need an extension, we will tell you within the initial 45-day period and explain the reason.

We provide responses free of charge up to twice annually per consumer. If requests are manifestly unfounded, excessive, or repetitive, we may charge a reasonable fee to cover administrative costs or decline to act on the request, where permitted by law.

If we deny your request in whole or in part, we will explain the reason. You may appeal by replying to our denial with "Appeal" or by submitting a new request labeled "Appeal" using the same contact methods listed above.

We will respond to appeals within 45 days of receipt. If we deny your appeal, we will provide a written explanation and provide an online mechanism, if available, or another method through which you may contact the Washington State Attorney General to submit a complaint.

12. Deletion Requests and Limits

If you request deletion of your consumer health data and we can verify your request, we will delete the consumer health data from our records as required by applicable law and notify applicable affiliates, processors, contractors, and other third parties with whom we shared the data, where required.

If consumer health data is stored in archived or backup systems, deletion from those systems may be delayed as permitted by law, but we will not use the retained backup copy for any new purpose.

We may decline or limit a deletion request where retention is permitted or required by applicable law or is reasonably necessary for legal obligations, tax or accounting records, insurance, safety, incident documentation, payment, dispute resolution, fraud prevention, or protection of pets, property, personnel, clients, or third parties.

13. Security Practices

We use reasonable and appropriate safeguards, scaled to the size, scope, and resources of our small business, intended to restrict access to consumer health data and protect it from unauthorized access, use, or disclosure.

Depending on the system involved, safeguards may include need-to-know access, password-protected accounts, multi-factor authentication where available and practical, passcode-protected devices, limiting access to sensitive records, secure disposal of paper records, use of reputable vendors, and confidentiality expectations for people who work with us.

No system is completely secure, and we cannot guarantee that consumer health data will never be accessed, lost, or disclosed without authorization.

14. Vendors and Processors

When vendors or service providers process consumer health data on our behalf, we seek to use written vendor terms, contracts, or other binding instructions that limit processing to our instructions and the purposes disclosed in this Policy.

Vendors and service providers may include email providers, cloud storage providers, phone/text providers, invoicing providers, website hosts, form providers, analytics tools, recordkeeping tools, and similar business systems.

If a vendor or processor cannot reasonably be bound to appropriate instructions for consumer health data, we will seek to minimize the consumer health data shared with that vendor or avoid sharing consumer health data with that vendor where practical.

15. Retention

We minimize consumer health data and retain it only as long as reasonably necessary for the purpose for which it was provided, unless longer retention is reasonably necessary for legal, safety, insurance, payment, incident-documentation, or dispute-resolution purposes.

16. Changes to This Policy

We may update this Policy from time to time. We will revise the "Last Updated" date when we do.

For material changes affecting the categories of consumer health data we collect, the purposes for collection, the categories of consumer health data we share, the categories of third parties or affiliates with whom we share it, or how you may exercise your rights, we will provide reasonably prominent notice and obtain affirmative consent where required before collecting, using, or sharing consumer health data for new categories or purposes.

17. Relationship to the General Privacy Policy

This MHMDA Consumer Health Data Policy applies only to consumer health data. Our general Privacy Policy applies to other personal information, including contact information, service information, home-access information, pet information, property information, payment records, communications, photos, website information, vendor information, cookies, and analytics.

Where this Policy and the general Privacy Policy address the same issue regarding consumer health data, this Policy controls.
